No, that's not actually true. As far as I know, in the US, copyright 
infringement constitutes injury-in-fact, whether or not any loss of income 
incurred. Courts can award $750-$150,000 per work of 'statutory damages' 
as well. I think you may be thinking of criminal liability, which can be 
absent even when there is a civil liability.

that purports to own any 1990s UNIX IP could claim a loss from anybody
reprinting a bunch of papers that never were marketed for sale.

Okay, there were the 9th and 10th edition manuals.  You, me, and maybe
200 others bought copies.  They have been out of print for decades.  No
loss of income could ever be imputed.

True, but I thought I spotted some on the list that were part of 3ed
but dropped from 4ed.  I don't have a 3ed here to compare to, so I'm

I would think that everything that shipped with 3ed or later Plan
9 distributions is subject to the same (release-specific) LICENSE
coverage, subject to the noted license exceptions.  But I don't
recall seeing any exceptions in relation to anything in /sys/doc.

We don’t really have permission to publish all these papers, especially not the ones that don’t ship with the GPLv2 release of Plan 9. The man pages are source code that ship with the system. Most of these papers are not; and even the ones that do ship with the system may be subject to copyright by their authors.
