Sorry, it must have been fixed in CVS if you mean:
(setq gnus-treat-date-lapsed 'head
gnus-article-date-lapsed-new-header t)
Please note that the value `t' for the `gnus-treat-*' variables
means Gnus does something in the article body.

Could you please install the fix in v5-10, too (if the problem exists
there)?
