You can use a custom headalternative setup:

  [myheader] []
  [alternative=myheader,

\startsetups [setup:myheader]
  \inouter{\headtextcontent}

The margin box itself is positioned correctly, but I have no clue
where the empty line comes from. You can visualise the box with:

  \setupmarginframed [inouter] [frame=on]
