The fix is with \label?  Sadly, no.  

The mechanism for a proper fix has been available for for over 
a decade in TeX's \holdinginserts, but has not been incorporated
in LaTeX.

i am using holding inserst in some places but it sucks since what you want
is not holding but using and reverting and inserts are nasty when it comes
to accessing their components.

We can discuss what is needed on the TeXlib list, if there are TeX
implementations details to discuss.
