For your information, I just tested the latest beta (ConTeXt ver: 2012.02.08 21:58 MKIV fmt: 2012.2.8) with my usual test suite and found that the following gives an error message:

\chapter{Testing a chapter\footnote{Actually for testing footnotes in a chapter header\dots}}
\stoptext

Hitting « r » the file typesets, but there is no number in the footnote, and the footnote number in the text is strangely very small.
