OK, found a sufficiant solution

 \setuphead[chapter][placehead=no]
 \setupheadertexts[][\setups{a}][][]\
\startsetups[a]
\expanded{\fetchmark[a][first]}
\stopsetups
\definemarking[a]
\starttext
 \chapter{my chapter}
\marking[a]{my chapter}
 \input knuth
 \stoptext

Any other ideas?
