OK, I can see that. I had a similar problem with a tabulate environment:

\setupcolors[state=start]

\starttext

\starttabulate[|rw(3em)|p|]

\NC 38 \NC \dontleavehmode \color[red]{some stupid text} \NC \NR

\stoptabulate

\stoptext

If you take out the \dontleavehmode, you get a spurious blank line.  
Is that the same cause?
